e-Admissibility: The Next Step Beyond e-Discovery
Today, litigators hide from the specter of electronic evidence. Questions of how to gather digital evidence and how such evidence will meet traditional requirements of admissibility in court loom in the minds of today’s trial attorneys. The new Federal Rules of Civil Procedure further begged the question of admissibility: how does one guarantee the authenticity and reliability of something intangible?
Federal Rule of Civil Procedure Rule 34(a) defines “electronically stored information” (ESI) as “data compilations stored in any medium that can be translated into a reasonably useable form.” This information can take various shapes and forms, including voice mail, instant messages, email or cellular phone text messages. Moreover, ESI can be found in unusual places, like thumb drives, MP3 players and portable phones.
A seasoned trial attorney may find herself asking, “how do you admit a thumb drive as a trial exhibit?” The quandary of how to admit this ocean of electronic evidence into court introduces us to the world of e-Admissibility.

Options for Integrating EDD Data in a DII File
Service Bureaus have many options for delivering processed eDiscovery (email and electronic documents) into Summation. The following links are to White Papers that detail new DII load file options. The White Papers are intended to help service bureaus adapt or create their own export utilities, or better use those contained in leading eDiscovery processing software, to create DII files for their clients who are using Summation.
Class 1 – Converted Image & Text + Family Summary DocID’s:
The class I DII file corresponds to the scanned paper paradigm used by many service bureaus for processing eDiscovery. In addition to image information, the service bureau adds parent and attachment Bates numbers to the DII record. This enables the Summation end-user to track family summary information – attachments related to the parent email and vice versa. More...
Class 2 – Native Files:
The Class II DII file is used to load email and electronic documents as “eDocs & eMail” in Summation. When faced with large volume electronic discovery disputes, some judges and magistrates have suggested a preference for electronic document productions as searchable native files. At the same time, they have expressed resistance to converting native files to images due to the cost and resulting information loss, such as inability to search a tiff file. Class 3 – Combined Native + Converted:
